About Chapter 7 Bankruptcy

If you don't have the ability to pay your debts, or you would like to come current on a delinquent debt, a Chapter 7 bankruptcy erases most debts. Specifically, this form of bankruptcy erases most unsecured debts and utilizes state or federal exemptions to leave the majority of your assets in your possession. This is the most common form of bankruptcy.

Non-Dischargeable Debts and Bankruptcy

Chapter 7 Bankruptcy does not erase all debt. You may still owe non-dischargeable debts whether you file for a chapter 7 or chapter 13 bankruptcy.

About Chapter 13 Bankruptcy

If you have the ability to pay all or part of your debts, you may be eligible for a Chapter 13 Bankruptcy. A repayment plan will describe in detail how you will pay each of your debts. Upon the completion of the plan, your remaining unsecured debts are discharged. The length of the repayment plan may be as long as 3-5 years depending on your income, debts, and monthly expenses.
