Collections Overview
Collections includes suits for money
judgments, foreclosures of mortgages and deeds of
trust, wage and bank account garnishments and writs
of execution (seizure of real and personal
property).
Collections Fees
We represent clients on an hourly basis, or on a
contingency fee (percentage of recovery) basis. There
are occasions when we represent a client on a reduced
hourly fee combined with a reduced percentage fee. At
your initial consultation, the fee arrangements will be
fully discussed and a written fee agreement outlining
the arrangement signed.
Collections Initial Interview
We will take the time to go over the facts to develop
the best legal strategy for recovery of what you are
owed, or for a defense if you are being sued.
Collections
Judgments
We always keep in mind the costs and likely end result
of litigation. Too often, clients get caught up in the
emotions of a case and pursue their action vigorously to
what appears to be a successful conclusion,
only to find out that their hard-fought judgment is
uncollectible. Although we may not be able to predict
such a conclusion, we strive to obtain results
for you that are beneficial and cost effective.
Collections
Small Claims
If the amount involved in the controversy is $4,000 of
less, we generally will suggest that you pursue the
matter in Small Claims Court, represent yourself or
forward the matter to a collection agency.
Unfortunately, relatively small cases (whether you are
defending or suing) are cost prohibitive when attorney's
fees are considered.
